Terms of Service

These terms govern your use of our website and your purchase of products from Party Boutiques. They are written to comply with the Ontario Consumer Protection Act, 2002.

These terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada.

Statutory Rights Preserved

Nothing in these terms limits or waives your rights under the Ontario Consumer Protection Act, 2002 or the Sale of Goods Act, R.S.O. 1990.

1. About Us

These Terms of Service (“Terms”) are entered into between you (“Customer”, “you”) and Party Boutiques (“we”, “our”, “us”), a retail party supply and event design business operating at:

By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

2. Internet Agreements — Ontario Consumer Protection Act, 2002

Purchases made on our website qualify as internet agreements under Part IV of the Ontario Consumer Protection Act, 2002(the “CPA”) where your total payment obligation exceeds $50, as prescribed by Ontario Regulation 17/05. We are required to make certain disclosures before you complete your purchase, and we do so through our checkout process and in these Terms.

The following information is provided in compliance with s. 38 and Ontario Regulation 17/05, s. 26:

  • Supplier: Party Boutiques, 7724 Yonge St, Thornhill, ON L4J 1W2
  • Description of goods: As displayed on our product pages. Descriptions are fair and accurate to the best of our knowledge.
  • Price: Itemized prices shown in your cart and at checkout, in Canadian dollars
  • Additional charges: Applicable taxes (HST) and Canada Post shipping rates — displayed at checkout before you confirm your order
  • Total payable: The final total, inclusive of all charges, is displayed on the checkout review page before you click “Place Order”
  • Payment methods: Credit card (Visa, Mastercard, American Express, Apple Pay) via Stripe
  • Delivery: Expected delivery window displayed at checkout based on shipping method selected; delivery to the address you specify
  • Currency: All prices are in Canadian dollars (CAD)
  • Return rights: As described in Section 6 and at /shipping

Following your purchase, we will send you a written order confirmation by email within 24 hours containing all of the above information, in compliance with CPA s. 39. This email constitutes delivery of the written copy of the internet agreement.

3. Cancellation Rights for Internet Agreements

Under the CPA, there is no general cooling-off period for internet agreements. Cancellation rights arise if we fail to fulfill our statutory obligations:

  • If we fail to make the required pre-agreement disclosures or fail to provide you with an express opportunity to accept, decline, or correct your order before completing the transaction, you may cancel at any time up to 7 days after receiving the written order confirmation.
  • If we fail to send you a written order confirmation within 15 days of your purchase, you may cancel within 30 days of the date of the agreement.

To exercise a cancellation right, contact us by email at support@partyboutiques.ca. If cancellation is valid, we will refund all amounts paid within 15 days of receiving your cancellation notice.

4. Products and Pricing

We make every effort to display accurate product descriptions, images, and prices. In the event of a pricing error, we will contact you before fulfilling your order to confirm the corrected price. You may choose to proceed at the correct price or cancel for a full refund.

Product images are representative. Colours may vary slightly depending on your display settings. Where quantity or size options are offered, please review your selection carefully on the checkout review page before confirming your order.

Prices do not include applicable taxes. Ontario HST (13%) is added at checkout. We reserve the right to change prices at any time; the price applicable to your order is the price shown at the time you complete checkout.

5. Payment

Payment is required at the time of purchase. We accept:

  • Major credit and debit cards (Visa, Mastercard, American Express) — processed securely by Stripe, Inc.
  • Apple Pay — processed securely by Stripe, Inc.

We do not store, access, or retain your raw payment card information. Card data is transmitted directly to and held by Stripe, Inc. under their PCI-DSS-compliant security programs. By providing payment information, you authorize the charge of the total amount shown at checkout.

6. Shipping and Delivery

We ship Canada-wide via Canada Post. Shipping rates are calculated at checkout based on your location, the weight of your order, and your chosen service level. Estimated delivery timeframes are shown at checkout and in your order confirmation.

Delivery timeframes are estimates, not guarantees. Canada Post delivery standards may be affected by peak periods, weather events, or carrier disruptions outside our control. For time-sensitive orders, please contact us before purchasing.

You will receive a shipment tracking number by email once your order is dispatched. If your order has not arrived within 5 business days of the estimated delivery date, please contact us and we will initiate a trace with Canada Post.

We are responsible for ensuring your goods arrive in satisfactory condition. If your order is lost in transit or arrives significantly damaged, we will reship or provide a full refund. Please retain all packaging and take photographs if your order arrives damaged, as we may need this documentation for a Canada Post claim.

7. Returns, Refunds, and Exchanges

We offer a 30-day change-of-mind return and exchange policy for eligible items. To be eligible for a return, items must be:

  • Returned within 30 days of the date of purchase
  • Unused, unassembled, and in their original packaging with all tags and accessories
  • Accompanied by the original receipt or order confirmation

The following items are not eligible for return or exchange due to their nature:

  • Custom or personalized items (including custom name balloons, personalized printing, and bespoke setups) — these are made to your specification and are non-refundable unless defective
  • Items that have been used, inflated, assembled, or altered
  • Items explicitly marked as final sale at the time of purchase

Defective, damaged, or incorrect items: Nothing in this policy limits your statutory rights. If you receive goods that are defective, damaged in transit, or materially different from what was described, we will repair, replace, or refund them in accordance with the Ontario Sale of Goods Act, R.S.O. 1990, c. S.1 (implied conditions of merchantability and fitness for purpose). This remedy is available to you regardless of the 30-day window above.

Return shipping costs for change-of-mind returns are at the customer's expense. Return shipping for defective or incorrect items is at our expense.

Approved refunds are processed to the original payment method within 5–10 business days of receiving and inspecting the returned item.

8. In-Store Pickup

Free in-store pickup is available at our Thornhill location. You will receive an email notification when your order is ready. Please bring your order confirmation and photo ID. Orders not collected within 14 days of the ready notification may be cancelled and refunded at our discretion.

9. Customer Accounts and Security

You may register for an account to access order history, saved addresses, and a wishlist. By creating an account, you accept the following responsibilities:

  • Credential security: You are solely responsible for keeping your email address and password confidential. Do not share your login details with any third party. We will never ask for your password by email, phone, or any channel other than the login screen on our website.
  • Account activity: You are responsible for all activity that occurs under your account, whether or not you authorized it. If you share your credentials or allow others to use your account, you accept liability for all actions taken under it.
  • Unauthorized access: You must notify us immediately at support@partyboutiques.ca if you become aware of any unauthorized access to or use of your account. We will take reasonable steps to help secure your account, but we are not liable for losses arising from unauthorized access where you have failed to maintain the security of your credentials.
  • Saved addresses: Shipping and billing addresses saved to your account are stored for your convenience and linked to future orders. You are responsible for keeping saved addresses accurate. We are not liable for delivery failures or misdeliveries resulting from an incorrect saved address used on an order you have confirmed.
  • Accurate information: You must provide truthful, accurate, and current information when creating your account and placing orders. We reserve the right to cancel orders or suspend accounts where information is found to be false or misleading.

We reserve the right to suspend or terminate accounts that are used in violation of these Terms, used fraudulently, or used in a manner that may harm Party Boutiques or other customers. Where feasible, we will notify you before taking such action.

10. Marketing Communications

We send promotional emails only to customers who have given express, opt-in consent in compliance with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). By checking the marketing opt-in box at account creation or checkout, you expressly consent to receiving commercial electronic messages from Party Boutiques, including promotional offers, product announcements, and event information.

By providing express consent, you acknowledge that:

  • Your receipt of marketing emails from us is authorized by you and constitutes lawful communication under CASL
  • We are entitled to continue sending marketing emails to you until you withdraw consent
  • Having agreed to receive marketing communications, you may not allege that such emails constitute spam, harassment, or unauthorized contact for the period during which your consent is active

How to unsubscribe: Every marketing email we send contains a clearly visible unsubscribe link. You may also opt out by contacting us directly. Once you withdraw consent, we will process your request and stop sending marketing emails within 10 business days as required by CASL s. 11. Unsubscribing from marketing does not affect your account, any active orders, or transactional communications (such as order confirmations and shipping notifications).

12. Intellectual Property

All content on our website — including text, images, logos, product photographs, and design elements — is owned by or licensed to Party Boutiques and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content from our website without our prior written permission.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Party Boutiques shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products, including (without limitation) loss of profits, loss of revenue, or losses arising from event cancellations beyond our reasonable control.

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in this section limits or excludes:

  • Your statutory rights under the Ontario Consumer Protection Act, 2002
  • Your rights under the Sale of Goods Act, R.S.O. 1990, c. S.1
  • Liability for personal injury caused by our negligence
  • Liability for fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under Ontario or Canadian law

14. Dispute Resolution

We are committed to resolving disputes fairly and efficiently. If you have a complaint, please contact us first at support@partyboutiques.ca. We will acknowledge your complaint within 5 business days and work to resolve it promptly.

If we cannot resolve your dispute through direct communication, you retain the right to pursue your claim through the Ontario court system. Nothing in these Terms requires you to resolve disputes through binding arbitration or waives your right to access the Ontario Superior Court of Justice, in accordance with s. 7(2) of the Consumer Protection Act, 2002.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, without prejudice to your right as a consumer to bring a claim in a court of competent jurisdiction in your own province or territory.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed severed from these Terms to the extent necessary, and the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of our website or placement of an order following a posted update constitutes acceptance of the revised Terms. For material changes, we will provide reasonable notice where feasible.
